A morganatic union is a marriage without the legal effects of marriage. It resembles a mismarriage in that the spouse and children are not entitled to the higher parent's rank and patrimony. A morganatic union, however, does not automatically trigger the application of applicable laws, as opposed to a mismarriage.

Feltman's opinion on morganatic marriages

A morganatic marital is a type that does not have the legal consequences of marriage. This is similar to a mismarriage in that the spouse and children don't share the highest parent's rank and there are no patrimony claims. This is largely because the marriage contract does not have full legal effect, whereas a mismarriage automatically applies the laws governing marriage.

Ehrenbach's follower, Feltman, wrote an opinion about morganatic marriages, which was published in the context of Zelst. In it, he argued that morganatic marriages could be unilaterally declared equal by the contracting party. This opinion also cites an opinion from the Helmstadt law faculty in Anhalt–Dessau/Fose, which held that the Anhalt–Dessau Princes in 1637 had imposed a house rule that prohibited unmorganatic marital relations.

Helmstadt's opinion concerning unequal marriage is one that has been cited as the most significant document in the history. This document lists the different types of marriages, both morganatic or non-morganatic. Unequal marriage is one in which neither party has more than equal rights. Unequal marriages are legal if the contracting parties agree to the conditions. Unequal marriages, which are permitted, are not allowed.

Morganatic marriages were rare in Germany in the late 18th Century, and were restricted to men of upper class. These contracts were virtually extinct by 1900.
